Law360 (Aug 10, 2021, 6:41 p.m. EDT) – The Eighth Circuit partially revived an Iowa state law on Tuesday aimed at criminalizing covert animal cruelty investigations on factory farms, upholding a provision prohibiting access to agricultural production facilities under “false pretenses.”

A federal district court had found that this and another provision criminalizing misrepresentation in the context of an application for employment at an agricultural production facility violated the First Amendment and invalidated the law. The Animal Legal Defense Fund and other groups have filed a lawsuit to overturn the law, claiming it is illegally blocking their attempts to investigate animal cruelty, and filed a new disputing complaint on Tuesday. ..
